Terms of Service

i-Oasis Terms of Service

i-Oasis offers a personalised subscription service that lets our users access virtual reality training content using an Oculus or HTC headset (devices compatible with the i-Oasis modules).

These Terms of Service govern your use of our services. As used here, the expressions "the i-Oasis service", "our service" or "the service" mean the personalised service provided by i-Oasis for finding and accessing i-Oasis content, including all features, recommendations and reviews, our websites and user interfaces, as well as all content associated with our service.

1 — Subscription

1.1

Your i-Oasis subscription continues until it is terminated. To use the i-Oasis service you must have Internet access and an i-Oasis-compatible device, and you must provide us with one or more Payment Methods. A "Payment Method" means a current, valid, accepted method of payment, which may be updated from time to time and may include payment through your account with a third party. Unless you cancel your subscription before your billing date, you authorise us to charge the subscription fee for the next billing cycle to your Payment Method (see "Termination" below).

1.2

We may offer a number of subscription plans, including subscriptions offered by third parties as part of the provision of their own products and services. We accept no responsibility for those products and services. Some subscription plans may carry different conditions and restrictions, which will be disclosed to you when you sign up or in other communications made available to you. You can find the specific details of your i-Oasis subscription by visiting the i-Oasis.com website and clicking the "Account" link at the top of the pages, under your profile name.

2 — Promotional offers

We may from time to time offer special promotional offers, plans and subscriptions ("Offers"). Offer eligibility is determined by i-Oasis at its sole discretion, and we reserve the right to revoke an Offer and suspend your account if we determine that you are not eligible. Members of your household who are already, or were recently, subscribed to i-Oasis are not eligible for certain introductory Offers. We may use information such as the device identifier, the Payment Method or an account email address used with an existing or recent i-Oasis subscription to determine Offer eligibility. Eligibility criteria and other restrictions and conditions will be disclosed to you when you sign up for the Offer or in other communications made available to you.

3 — Billing and termination

3.1. Billing cycle

The subscription fee for the i-Oasis service, along with any other charges connected with your use of the service such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date shown on the "Account" page. The length of your billing cycle depends on the type of subscription you chose when you signed up for the service. In some cases your payment date may change — for example, if your Payment Method has not been successfully settled, when you change plan, or if your paid subscription began on a day not contained in a given month. Please visit the i-Oasis.com website and click the "Billing details" link on the "Account" page to find your next billing date. We may verify your Payment Method in anticipation of subscription or service-related charges in a number of ways, including by authorising it for an amount of up to roughly one month of service as soon as you sign up. If you signed up for i-Oasis using an account you hold with a third party as your Payment Method, you can find the billing information for your i-Oasis subscription by visiting your account with that third party.

3.2. Payment Methods

To use the i-Oasis service you must provide us with one or more Payment Methods. You authorise us to charge your account through any Payment Method associated with it should your primary Payment Method be declined or no longer be available to us for the payment of your subscription fee. You remain liable for any amount not collected. If a payment fails because the card has expired, because of insufficient funds or for any other reason, and you do not cancel your account, we may suspend your access to our service until we have successfully charged a valid Payment Method. For some Payment Methods the provider may charge you certain fees, such as international transaction fees or other charges relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Please contact your Payment Method provider to find out more.

3.3. Updating your Payment Methods

You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by payment service providers. Following any update, you authorise us to continue charging your account through the relevant Payment Method or Methods.

3.4. Termination

You can cancel your i-Oasis subscription at any time and you will continue to have access to the service through the end of your billing period. To the extent permitted by applicable law, payments are non-refundable and we do not provide refunds or credits for partial use periods or for any unused i-Oasis content. To cancel your subscription, go to the "Account" page and follow the instructions. If you cancel your subscription, your account will close automatically at the end of your current billing period. To find out when your account will close, please click "Billing details" under "Account". If you signed up for i-Oasis using an account you hold with a third party as your Payment Method and you wish to cancel your i-Oasis subscription, you may need to do so through that third party — for example, by visiting your account with that third party and turning off automatic renewal, or by unsubscribing from the i-Oasis service through that third party.

3.5. Changes to prices and subscriptions

We may change our subscriptions and the price of our service from time to time. However, any changes to pricing or to your subscriptions will only take effect after a minimum of 30 days following receipt of a notification from us.

4 — The i-Oasis service

4.1

You must be at least 18 years old, or have reached the age of majority in your province, territory or country, to subscribe to the i-Oasis service. Minors may use the service only under the supervision of an adult.

4.2

The i-Oasis service, and any content you access through the service, is for personal and non-commercial use only and must not be shared with people outside your household. For the duration of your subscription we grant you a limited, non-exclusive, non-transferable right to access the i-Oasis service and i-Oasis content. Beyond the foregoing, no right, title or interest is granted to you. You agree not to use the service for public performances.

4.3

You may access i-Oasis content only in countries where we offer our service and hold the corresponding licences. The content available may vary by geographic region and may change at any time. The number of devices on which you can watch content simultaneously depends on the type of subscription you chose and is stated on the "Account" page.

4.4

The i-Oasis service, including the library content, is updated regularly. We likewise test different aspects of our service on a regular basis, including our websites, our user interfaces, our promotional offers and the availability of i-Oasis content. You can opt out of taking part in tests at any time by going to the "Account" page and changing the "Test participation" settings.

4.5

Some i-Oasis content may be temporarily downloaded and viewed offline on certain compatible devices ("Offline Titles"). Limitations apply, including restrictions on the number of Offline Titles per account, the maximum number of devices onto which Offline Titles can be downloaded, the period within which you must begin playing Offline Titles and the length of time Offline Titles remain accessible. Some Offline Titles cannot be watched in certain countries, and if you connect from a country in which that title cannot be streamed, it cannot be watched for as long as you are in that country.

4.6

You agree to use the i-Oasis service, including all associated options and features, in accordance with the applicable laws, rules and regulations, and with any restrictions on the use of the service or of the content offered. You undertake not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, sell or use (except as expressly authorised in these Terms of Service) the content and information of, or obtained through, the i-Oasis service. You further undertake not to: circumvent, remove, alter, deactivate, destroy or defeat the content protections in the i-Oasis service; use robots, crawlers, web-scraping tools or other automated methods to access the i-Oasis service; decompile, reverse-engineer or disassemble any software, product or process accessible through the i-Oasis service; insert any code or product, or manipulate the content of the i-Oasis service in any way; or use any data-mining, data-gathering or data-extraction method. Likewise, you undertake not to upload, post, email or otherwise send or transmit any content intended to interrupt, destroy or limit the functionality of any software or computer or telecommunications equipment associated with the i-Oasis service, including any virus or any other computer code, file or program. We reserve the right to terminate or restrict your use of our service if you breach these Terms of Service or make unlawful or improper use of the service.

4.7

The display quality of i-Oasis content may vary from one device to another and may be affected by a range of factors, including your location, the bandwidth available and/or the speed of your Internet connection. The availability of HD, Ultra HD and HDR formats depends on your Internet connection and on the capabilities of the device. Not all content is available in all formats, in particular HD, Ultra HD and HDR, and not all subscription types allow content to be viewed in every format. By default, playback settings on a cellular network exclude HD, Ultra HD and HDR content. For SD quality, your system must have a connection speed of at least 1 Mbit/s. A download speed of at least 3 Mbit/s per stream is recommended in order to watch HD content (720p or above). A download speed of at least 15 Mbit/s per stream is recommended in order to watch Ultra HD content (4K or above). Internet connection charges are your responsibility. Please contact your Internet service provider to find out more about any Internet data usage charges. The time it takes before you can watch i-Oasis content varies according to several factors, including your location, the bandwidth available at the time you watch the title, the content selected and the configuration of your i-Oasis-compatible device.

4.8

The i-Oasis software is designed by or for i-Oasis and must be used solely for authorised streaming of i-Oasis content and for accessing i-Oasis content through i-Oasis-compatible devices. This software may vary depending on the device and medium used; features and characteristics may also vary by device. By using our service, you acknowledge that it may require the use of third-party software subject to those third parties' licence terms. You agree to receive updated versions of the i-Oasis software, or of third-party software associated with the service, automatically.

5 — Passwords and account access

The user who created the i-Oasis account and is charged the subscription fee through the chosen Payment Method (the "Account Holder") is responsible for all activity that occurs through their i-Oasis account. In order to keep control of the account and to prevent anyone from accessing it (and in particular from accessing the account's viewing history), the Account Holder must keep control of the i-Oasis-compatible devices used to access the service and must not disclose their password, or the details of the Payment Method associated with the account, to anyone. You are responsible for updating and maintaining accurate information relating to your account. We may terminate or suspend your account in order to protect you, as well as to protect i-Oasis or its partners, against identity theft or any other fraudulent activity.

6 — Warranties and limitations of liability

The i-Oasis service is provided "as is" and without warranty or condition of any kind. In particular, we do not warrant that our service will operate without interruption or be free of errors. You waive any claim against us for special, indirect and consequential damages. These Terms of Service do not limit any non-excludable warranties or consumer protection provisions you may be entitled to under the law in force in your country of residence.

7 — Class action waiver

WHERE APPLICABLE LAW PERMITS, YOU AND i-Oasis AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

Furthermore, where applicable law permits and unless otherwise agreed between you and i-Oasis, the competent court may not consolidate the claims of more than one person and may not preside over any form of class or representative proceeding.

8 — Miscellaneous

8.1. Governing law

These Terms of Service are governed by and construed in accordance with the law of the Netherlands.

8.2. Unsolicited material

i-Oasis does not accept unsolicited materials or ideas relating to i-Oasis content, and disclaims all liability for any similarity between its content or programming and the materials or ideas submitted to it.

8.3. Customer support

To find out more about our service and its features, or if you need help using your account, please visit the i-Oasis Help Centre, accessible from the i-Oasis.com website. In some cases, Customer Support may assist you using a help and remote-access tool through which we will have full control of your computer. If you do not wish to give us that access, you should decline assistance via the remote-access tool and we will then help you by other means. In the event of a conflict between these Terms of Service and information given by Customer Support or offered in other sections of our websites, these terms prevail.

8.4. Severability

If one or more provisions of these Terms of Service are found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force and effect.

8.5. Changes to the Terms of Service and assignment

i-Oasis may amend these Terms of Service from time to time. We will notify you at least 30 days before such changes take effect. We may assign or transfer this agreement with you, including the rights and obligations attaching to it, at any time, and you agree to cooperate with us in connection with such an assignment or transfer.

8.6. Electronic communications

We will send you information relating to your account (for example, payment authorisations, invoices, password or Payment Method changes, confirmation messages, notifications) electronically only — for instance by sending an email to the email address you provided when you signed up.
